- Do I need a revenue stamp on every rent receipt?
- Only when the monthly rent exceeds ₹5,000 and the payment is made in cash. If you pay by bank transfer, UPI, NEFT, or cheque the payment leaves its own electronic trail and a revenue stamp is not required regardless of the rent amount. The Indian Stamp Act, 1899 prescribes a ₹1 stamp for cash receipts above ₹5,000; this is what employers and tax officers look for when they ask about stamps.
- When is the landlord PAN mandatory?
- The moment your annual rent crosses ₹1,00,000 — even by a single rupee — the landlord PAN must be on the receipts you submit to your employer and the disclosure in your tax return. ₹8,334 per month is the practical break-even point; above that you are over the annual threshold. If your landlord refuses to share PAN, the Income Tax Act lets you file a declaration in Form 60 in their place, but expect your employer to scrutinise it carefully.
- Can I claim HRA if I pay rent to my parents?
- Yes, the Income Tax Act explicitly allows it, but three conditions must be true. One — there must be a genuine rental agreement, written and ideally registered. Two — rent must be paid through bank transfer to the parents account, not cash. Three — the parents must declare the rent received as rental income in their own ITR. From April 1 2026 you must also disclose the parent relationship in Form 124, so the deduction can be cross-verified by the tax department.
- What is Form 124 and how is it different from Form 12BB?
- Form 124 is the new investment and exemption declaration form salaried employees give their employer, effective April 1 2026. It replaces the older Form 12BB. The two key changes for HRA claimants are: a mandatory disclosure of the landlords relationship to the tenant when rent is paid to a relative, and a stricter format around landlord PAN reporting. The receipts themselves stay similar; it is the declaration form that became more granular.
- Do I need an actual rent agreement to claim HRA?
- The Income Tax Act does not strictly require a formal registered rental agreement to claim HRA — but practically every employer asks for one above ₹50,000 per month, and the tax department uses it as supporting evidence during scrutiny. If you do not have a written agreement, your rent receipts must be detailed and consistent: same landlord, same address, same amount, paid by bank transfer with the payment date visible. Get the receipts signed by the landlord, ideally on each month.
- Does HRA work under the new tax regime?
- No. HRA exemption under Section 10(13A) is only available under the old tax regime. The new tax regime, which is the default from FY 2025-26, replaces individual exemptions with a flat ₹75,000 standard deduction and lower slab rates. If you have significant rent payments, run both regimes through an income tax calculator before deciding — for many high-rent metro renters the old regime with HRA still wins.
- How many receipts do I need to generate — one per month or one for the year?
- Most HR teams want twelve monthly receipts, one per month of the financial year. A single annual receipt is also acceptable to the Income Tax Department but employers prefer the month-by-month trail because it matches the salary credit and rent debit pattern in your bank statement. This tool defaults to twelve monthly receipts in a single PDF for that reason.
